1. Law Enforcement & Government Agencies

I am a member of Law Enforcement or a Government Agency (or “LEA”) and need to serve UScellular with a legal demand for subscriber records.

A. Exigent Circumstance Support

  • Exigent requests will only be fulfilled after submission of a properly completed Exigent Circumstance form.

  • EXIGENT CIRCUMSTANCE FORM
  • Requestors must subsequently call 800-333-4847 for compliance and must continue to call for updated location PINGs. UScellular does not have automated PING capability.
  • UScellular Exigent Circumstance webform is required – we will no longer accept the old paper form – submissions MUST use the above webform.
  • The form must:
    • Be completed in its entirety
    • Be signed by an authorized representative of the requesting agency
  • Submissions are valid for 24 hours. A Search Warrant is required for release of records after the limited Exigent Circumstance 24 hour period expires.
  • Unauthorized exigent requests are subject to punishment to the full extent of the law.

B. Historical Requests - Legal Process

  • Preservation requests
    • UScellular will preserve records only at the request of Law Enforcement.
    • In order to request preservation of records, the LEA must send a letter on agency letterhead indicating the nature of the preservation request, target, and date/time frame.
    • Records will be preserved no longer than 90 days.

C. CALEA Intercepts PEN / Title 3

  • A UScellular CALEA request form must accompany all CALEA intercept requests. Failure to initially provide the form will cause a delay in setup.
  • UScellular will not initiate setup without a completed CALEA request form.
  • To ensure prompt and proper setup - on the CALEA request form – you must specify the specific pre-established CALEA VPN Tunnel and the destination IP address for delivery.
  • If your agency needs to modify or establish new CALEA VPN Tunnel, email us with the request.

D. Tower Dump (Area Search) Requests

  • UScellular Tower Dump Request WebForm must accompany all Tower Dump (Area Search) requests. Failure to initially provide the form will cause undue delay.
  • UScellular will not fulfill Tower Dumps without a completed Tower Dump Request WebForm.

2. Non-Government

I am not a member of Law Enforcement or a Government Agency but need to submit a legal demand for subscriber records.

A. Garnishments

  • Submit all requests for wage garnishments using UScelluar Registered Agent at Corporation Service Company.
  • Do not send garnishments to Subpoena Compliance as this may cause undue delay.

B. Legal Demands for subscriber records:

  • Must be submitted by an authorized Attorney – UScellular will not respond to submissions directly from customers or release any records directly to customers.
  • Before submitting legal process for requests related to any civil and criminal proceedings, first review the Non-Government (Law Firm) Records Request Resource Guide for details regarding available records & retention, fees, and delivery.
  • Pre-Payment is required – UScellular will only release records after receipt of payment.
  • An invoice detailing applicable processing charges will be provided 2-4 business days after UScellular receives your legal process submission.
  • It is the responsibility of the submitting attorney to ensure that the request is legally sufficient to permit UScellular to lawfully release the full scope of requested records. UScellular is not responsible for any request which fails to meet the applicable legal standard, and it will deny all requests if any portion of the scope of the records sought exceeds the legal requirements provided for their release. In the event the request is denied, UScellular will require an entirely new legal demand submission. UScellular will not provide secondary review in response to general correspondence on any denied requests.
  • We will not honor preservations requests from any non-government entities. UScellular will preserve records only at the request of Law Enforcement.

3. I am a UScellular® customer or member of the general public seeking records.

  • The UScellular Subpoena Compliance department will not release any records directly to its customers or give legal advice. For assistance with billing records contact Customer Service or visit a retail store for assistance.
  • Any correspondence received by Subpoena Compliance Department that is meant for or can be handled by UScellular Customer Service will not be answered. See Customer Service Contact information
  • If you need records related to an alleged crime contact Law Enforcement. UScellular Subpoena Compliance department will not release records directly to customers.
  • If you need records for a civil dispute, you must work with an attorney to properly serve UScellular with a legal demand – we will not respond to requests received directly from customers.

Please observe the following courtesies when submitting to avoid undue delay.

  • Don’t submit handwritten requests – Typed requests are preferred to ensure our system accurately identifies and captures details of the request. Handwritten submission may cause a delayed response.
  • Don’t send multiple legal demands under one submission - If you have multiple requests, please send only one legal process per submission.
  • Don’t submit the same legal demand twice – It is not necessary to both email and physical mail the same request.

Frequently Asked Questions

  • Exigent Circumstance requests must be submitted via webform. Click here to access the form. UScellular Exigent Circumstance webform is required – we will no longer accept the old paper form – submissions MUST use the above webform
  • Requestors must subsequently call for compliance on submitted Exigent Circumstance Forms. UScellular will not follow up on received Exigent Circumstance submissions, you must call for service.
  • SMS content does not exist beyond 3-5 days from when message was sent/received. Requests for SMS content beyond this time frame cannot be fulfilled.

    SMS content will not be released without submission of Search Warrant or Court Order signed by a Judge.

  • UScellular does not maintain historical assignment records of IP addresses and thus cannot associate an IP address to the specific subscriber that utilized it to support wireless data network activity at a given date/time. Specifically, IP address assignments may be shared simultaneously by a large volume of subscribers and re-assignment occurs frequently on a per session basis. UScellular network security infrastructure, which processes IP assignment and translation for a specific individual subscriber, does not record history of these events. As a result, no records exist.
  • UScellular cannot access any payment card or financial account information. UScellular does not directly store this information and its inability to retrieve it is by design as a result of our vendor support model.
  • UScellular will preserve records ONLY at the request of LEA.

    All other requestors will be provided with records available at the time when the request is processed, and not from the time when legal demand was served.

  • UScellular must receive a subpoena at least 10 business days in advance of the court date in order for UScellular to comply with the request for a UScellular records custodian to appear at court to testify. Subpoenas can be submitted to the Subpoena Compliance Department via email at: SubpoenaCompliance@uscellular.com
