Voicemail To Text Terms & Conditions

The UScellular® Voicemail to Text Service (the "V2T Service") is designed to convert voicemail messages to text format for delivery to users' wireless devices or email accounts using fully automated speech recognition technology. The V2T Service is provided to users as a "Service" under the terms of UScellular's standard Customer Service Agreement (the "Agreement") available at uscellular.com/legal. These V2T Service Terms and Conditions, the Agreement and UScellular Privacy Statement available at uscellular.com/privacy (collectively, these "Terms") form the basis of the agreement for the V2T Service between the user ("you" and "your") and United States Cellular Corporation on behalf of itself and its operating license affiliates doing business as UScellular in your Home Market, as defined in the Agreement ("UScellular"). By using the V2T Service, you are agreeing to be bound by the Terms. You may not use the V2T Service unless you have agreed to these Terms.

Authorization for V2T Service

By using the V2T Service, in addition to the authorizations that you provided UScellular in the Agreement, you authorize the UScellular third-party vendors that provide the V2T Service to use and retain all or portions of your voicemail messages and the text transcriptions of such messages ("Transcriptions") to render, tune, enhance and improve the V2T Service and their speech recognition technologies and to provide to third parties statistical models derived therefrom to their research and development partners and contractors for such purposes.

Delivery and Use

You are responsible for enabling your voicemail password to listen to voicemail messages, logging into the preferences portal to provide your delivery preferences and protecting your password. You are responsible for providing a correct email address and updating the email address through the preferences portal when there are changes made to the address of your email account. Neither UScellular nor its V2T Service vendors shall be responsible for Transcriptions sent to incorrect email addresses that you provide. As a result of system constraints, the V2T Service may not fully transcribe some voicemail messages and related Transcriptions will appear as incomplete text messages. Such incomplete Transcriptions will be denoted by an ellipsis "..." or some other indication that your Transcription is incomplete or your voicemail message has been truncated. In such situations, you may obtain the full message by listening to your voicemail message.

Disclaimer

The V2T service is provided as-is and as-available and both UScellular and its third-party service vendors disclaim any and all warranties, express or implied, regarding the V2T service including any warranties of merchantability, fitness for a particular purpose and non-infringement to the extent permitted by applicable law. The V2T Service does not use human transcribers and there is a probability of transcription errors. Transcription times are not guaranteed. Accordingly, you should not use the V2T Service for mission critical purposes. Voicemail messages are not controlled or filtered in any way. Neither UScellular nor its V2T Service vendors are responsible for errors in the conversion of voicemail messages to text or for content that is unlawful, harmful, threatening, abusive, vulgar, obscene, tortious or otherwise objectionable. You cannot use the V2T Service unless you have text messaging on your account.

Limitation of Liability

In no event shall UScellular or its V2T service vendors be liable for any direct, indirect, special, consequential or punitive damages arising from your use of the V2T service, including but not limited to, loss of revenues and loss of profits, even if UScellular or such vendor has been advised of the possibility of such damages.

Restrictions

You may not use the V2T Service for any unlawful, improper, harassing or abusive purpose or in such a way that interferes with UScellular network, business operations, employees or customers and UScellular may interrupt, restrict or terminate the V2T Service to you without notice in its sole discretion. you may not submit any pre-recorded voicemails to the V2T Service for transcription or use any automated process to access the V2T Service.

Proprietary Rights

UScellular and/or its V2T Service vendors own all rights in and to the V2T Service. Except as expressly stated herein, these Terms do not grant any rights to or in, patents, copyrights, database rights, trade secrets, trade names, trade marks (whether registered or unregistered) or any other rights or licenses in respect of or related to, the V2T Service or any related documentation.

Free Trial

You are entitled to one 30-day free trial of the V2T Service per calendar year provided your account is current with all balances and you have not previously subscribed to the V2T Service.

Conversion to Fee Based V2T Service

You will be given 2 opportunities to opt out of the V2T Service at the end of the 30-day trial before charges will be assessed. UScellular will provide you with an SMS message to remind you to opt out of the V2T Service on or after day 26 of the trial and a second time on day 30. If you do not opt out of the V2T Service by responding "STOP" to the SMS message by day 30, you will be charged the applicable monthly service charge each calendar month thereafter until you cancel the V2T Service as provided below.

Charges

Charges include the conversion of the voicemail message to the Transcription that is delivered to you according to your preferences. Additional charges, however, may apply based on your UScellular service plan such as for receiving email or text messages on your wireless device or replying to or forwarding the Transcription via SMS or email.

Cancellation

Once you have the V2T Service, you must call Customer Care at #611 or 888-944-9400 or visit a UScellular retail store to cancel your V2T Service.

Conflict

In the event of conflict between these V2T Service Terms and Conditions and the terms and conditions in the Agreement or UScellular Privacy Statement, these V2T Service Terms and Conditions shall govern to the extent of the inconsistency, but only as it applies to the V2T Service.
